Terms of Service
Effective June 5, 2026
These Terms of Service ("Terms") govern your use of the San Francisco Welcome Department website and programs (the "Project"), operated by BENEATH THE SIDEWALK, LLC ("we," "us," or "our"). By using this website, taking the text-message orientation, or visiting the pop-up field office, you agree to these Terms. If you do not agree, please do not use the Project.
1. The Project is fictional
The San Francisco Welcome Department is a work of speculative civic design by Sara Chandler, created for the 2026 Future of Us Festival. It is not a government agency and is not affiliated with, endorsed by, or operating on behalf of the City and County of San Francisco or any government body. Any "credential," "registry," "orientation," "pledge," or "intake" is part of an art project and confers no official status, rights, benefits, or services.
2. The text-message orientation
- By texting the Project, you consent to receive automated and manual text messages about the orientation. Message frequency varies; message and data rates may apply. Reply STOP to opt out and HELP for help.
- The orientation is offered for civic-imagination and entertainment purposes. Any suggestion to walk, travel, or visit a place is a prompt you choose to follow at your own discretion and risk. You are responsible for your own safety and for obeying all laws, traffic signals, posted rules, and private-property rights.
- Release of liability. To the fullest extent permitted by law, you release, waive, and agree to hold harmless BENEATH THE SIDEWALK, LLC, Sara Chandler, and their collaborators, partners, and agents from any and all claims, demands, injuries, losses, or damages of any kind arising out of or related to your participation in the orientation or your reliance on any message you receive.
3. The pop-up field office (in-person event)
- Attendance at the pop-up field office is voluntary. You attend at your own risk and assume all risks associated with being present at a public event and moving about the venue and surrounding area.
- Waiver and release. To the fullest extent permitted by law, you release and discharge BENEATH THE SIDEWALK, LLC, Sara Chandler, and their collaborators, volunteers, partners, and venue hosts from any liability for any injury, illness, loss, or damage to person or property arising out of or related to your attendance at or participation in the pop-up field office.
- You agree to follow venue rules and the instructions of Project staff and volunteers.
4. Intellectual property
The Project's name, text, design, logo, and other content are owned by BENEATH THE SIDEWALK, LLC, unless otherwise noted, and may not be used without permission.
5. No warranties
The website and the Project are provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the site or the orientation will be uninterrupted, accurate, or error-free.
6. Limitation of liability
To the fullest extent permitted by law, BENEATH THE SIDEWALK, LLC and Sara Chandler will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the website, the orientation, or the pop-up field office.
7. Indemnification
You agree to indemnify and hold harmless BENEATH THE SIDEWALK, LLC and Sara Chandler from any claims or expenses arising out of your misuse of the Project or your violation of these Terms.
8. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in San Francisco, California.
9. Changes to these Terms
We may update these Terms from time to time. The "Effective" date above shows when they were last revised. Continued use of the Project after changes means you accept the updated Terms.
